شي حلو و يحسسك بالفخر إن ينشرون أعمالك حتى العالم كله يطلع عليها .. لكن شالفايدة لو العالم اللي قاعد يطالع الصورة جاهل منو مصورها .. بالإضافة لعدم وجود أي حق في نشرها من غير إذن صاحبها

I will tell you how it works here,
me as a designer, I look sometime for pictures, stock photographs like from http://www.sxc.hu for free, and Flickr users sometimes give that permission, but I dont take the photo except when I ask the owner, moslty egyptian designers dont care for the premission, they just go and take the pictures without any glance of the owner, u know I used to work in an office which buy photography books and they used to scan the pictures inside for famous photographers!! I left that office because I didnt want to stay in such system. and I found that 90% of Egypt do it the same way, that's why I'm in Dubai now and looking for a job, and for more Dis-advatages in Egypt too.
If you say that the head office in London, you could go to the courtlaw for that, butin Egypt " rabenna ma3ak "

Well you should contact the editor of the magazine/site. Every magazine has contact information for the Chief Editor (usually in the table of contents section). You can search online for “cease and desist” letters regarding copyright infringement. Email the Chief editor and CC anyone you can find in the editorial department.
You can send an email to ask them that they MUST link to your flickr account and give you proper credit as well as pay for its' use. Or to take it down immediately and pay for the un-authorized use of it. Make sure in your email you mention that they have a week to contact you
If they don't respond to you, you can always blog it and use digg.com to point to your blog and from there explain what happened. You can point to their site and get the world community on your side...
Wait!!! I just looked at your image on flickr. It's Public Domain! You classified the image as for access into the public domain! Hmmm, if you go here: http://creativecommons.org/licenses/publicdomain/
It explains your rights. It seems like you can't ask for much here from the magazine. In this case, your best bet is to write a letter to the editor and say how you like or dislike the article with your picture and perhaps ask them to let you contribute an article and or let them link to your blog. Mutual benefit...

First of all, i appreciate that we share the culture of property rights and we all are horrified by the idea of having our work being used without our permession.
However, i was dissapointed to see the reaction that you took to what happened, and the way you previews the case!
I didnt tell you that i am actually a writer in TEENSTUFF magazine, and i know doaa samy personally and i know the system in the magazine, where you should have asked about before raising accusations against the magazine...
please re-send your e-mail to INFO@TEENSTUFFONLINE.COM cause they didnt recive it!
From my point as a fellow writer in the magazine, i have to tell you that the main office is in MOHANDSEEN. SYRIA ST. and not in LONDON, the one in london is office of TPA, the company of teenstuff and kelmetna. dont forget teenstuff is here sinec 11 YEARS! and back then the freedom of issuing a magazine in egypt was not as easy as it is now...so please dont start conspiracies cause there AINT NONE!
secondly, your picture was posted on FLICKR, and after reading the terms of use, whom i doubt you did read, i found out that it is clear that this is a pictures SHARING website, as writing in thier home page, and here i quote: "FLICKR, the best way to store,search,sort & SHARE your photos" and having the picture UPLOADED by you doesnt mean that its COPYRIGHTED for you... you know what copy right is, and this is something else.
so what happens in the magazine is, we writers write articles, and the designer searches the internet for relevant pictures, and your pictures came out in the results as an OPEN LICENSED picture, cause you have it hosted in A SHARING website. so i am not telling you that because legally you dont own it means that the magazine had the right to use it, but also i want to tell you that having it uploaded by you doesnt mean that it also a product of your work!
so think of it this way, and dont make it a case, cause its not.
those were my thoughts regarding the case, i dont represent the magazine, cause they will relpy to your e-mail once you send it again. i just wrote my own personal opinion regarding what happened to you.
so please dont get offended by what happened, i told you how things go, and i am sorry if this has really offended you. but dont forget the the TIME magazine awarded this year's "man of the year award" to 'YOU' refering to all people like us who share thier stuff on the internet and help the internet grow with our own contributions, and your picture was one of those contributions.

Ok, I worked and wrote in TeenStuff for 4 years but now I don't.. So I should be objective about this, since I no longer work in TeenStuff nor do I take their side if they're wrong. As Yasser said, the office is in Egypt and what's in London was only the license for the magazine, so rule out conspiracy theory. Now I can't say much about this part, but yeah they get pix off the Internet.. I looked the your Flickr page and you don't have any clear disclaimer. I'm not saying that you don't have copyrights, or that you do, but I'm stating the factual scene now. It isn't clear whether your pictures are under the Public Domain or under "Attribution-NonCommercial-ShareAlike 2.5", unlike your blog which has a clear big statement saying it's under that.
Again, I'm not defending the magazine by any means. I think respecting copyrights is a basic thing and it's high time Egyptian publishers and businesses know how to respect it. But I'm just saying your case isn't really clear-cut.
This is Doaa Samy, Head of the Poetry Club that had the picture beside one of the poems published in our Poetry Section -December 2006.
Well, I knew all about this few hours ago when a friend of mine sent me the link to this site, asking me to check out because there seemed to be a problem. I directly clicked on the URL and was driven to the page you're reading this at.
I was surprised and shocked at the same time after reading what you wrote beside the picture above at the top and found a scanned copy of the magazine page...I hesitated either to write here or let the manager editor know and connect you to the office, but after I read Yasser's message and Menna's too (as such both of them are dear friends from the magazine) I just felt I had to speak.
First of all, I assure you that no one knows that this picture belongs to you. As Yasser said, the designer gets all the pictures via the internet without any specific type of search nor even using any special search engine. (And for the third time, Teen Stuff head office is in Syria street - Mohandessine, which is clearly shown in the magazine itself.
Second, I totally support your right in protecting your picture YET as Menna mentioned, the picture was not completely and clearly announced to be copyrighted. You should have showed it 100 percent for instance by having your name carved on the picture itself or something (just an idea to show full protection). Because, when anyone does search and find pictures on shared sites and has nothing clearly telling it's subjected to copyright, then how would they ever know it is?
Third, referring to my name written there. I just wanted to tell you that I am a writer neither a designer nor a photographer which means that I have nothing to do with the pictures associated with my articles or poems. However I again assure you that the designer has no idea about it being yours.
Fourth is a question actually. After writing to the magazine and getting no replies, why didn't you try to deeply seearch the pages for any addresses or phone numbers to contact? I will surprise you and announce that in the very same red rectangle where you read that the head office is in london, you will find the word "EGYPT" followed by the address here in Mohandessine and the office telephone number. Check again?
Fifth and last, I tell you that the magazine has received nothing. And don't know about it uptil now. And I have already sent them this link to check. A last request is you sending an email also as Yasser said to info@teenstuffonline.com and be sure that this time you'll get a reply.
There are no need for disputes and fights; especially after letting you know how it works and that the magazine knows nothing about it.
Make sure to clearly and totally protect your production from now on, not to get engaged into misunderstandings.
The magazine is way beyond creating problems and getting into conflicts.

I've been keeping an eye on this subject for a while, and while I tried I stay out of it, some of the comments thrown around here has really ticked me off and I am going to have my say on them, one by one.
First of all, allow me to introduce myself: I have been writing for TeenStuff for more than 5 years now, and even though I moved on, TeenStuff and the people working there still hold a special place in my heart. The way I see the magazine pinned as an establishment that capitalizes on others work, or some money hungry cheap tabloid really sickens me. Because I know that this is not what TeenStuff is about. None of the people who have responded on behalf of the staff, all fellow colleagues, 'work' for TeenStuff in the normal sense: We don't get paid for what we write, and I think the proper word here is 'contributors'. We did not jump up to respond because بتوع المجله ارتعدت فرائصهم يا بطل as your fellow friend puts it, but because we hate to see lots of wrong things being said about the magazine for no apparent reason other than there is a current misunderstanding between both of you. No one has pushed me to do it, and my only obligation to go through this is because TeenStuff has given me so much it's only proper that I speak out for it when it is being humiliated in such a vicious manner out in the open. Quickly, a mountain has been made out of an ant hill, the whole matter was pitched as a David versus Golaith/ 'one man versus the establishment' sort of wornout tale that we all know too well, which is not really what it is. Deep down, all what this ordeal about is a simple mistake.
Now let's get back to the main issue: your picture, their usage. What happenned is a simple mistake than any other magazine might have fallen in to. Your image is copyrighted, I give you that, but it is available on a public domain, and someone mistakenly thought they could use it freely. It is not a targeted attack against your person, and there is no 'conspiracy theory' behind it like some comments suggest so, conspiracy theorists out there, calm down. It is common for magazines to use pictures available on the Internet, specially ones available on public domains, and most people have no problem with it, but it seems you do. I am not saying that you should not be upset about it: this is your work and it should be acknowledged that it is yours. It is your most basic and fundamental right. Heck, you can ask for financial rewarding if you want and no one will disagree.
I assume that you have tried to contact the magazine and haven't got any reply. Yet. With a magazine like TeenStuff, one that is mainly based on open contributions coming from teens, can you imagine the amount of e-mails they receive on a daily basis? I am sure it is just a matter of time that they'll get to your e-mail and contact you. The people who work there are not the kind of people who scam others. The entire magazine is based on contributions coming from everyone and anyone, and every month they give credit to hundreds of different teenagers who are not officially related to them. They encourage people like me and you, people who have a passion or a talent for something, whether it is writing, or art, or photographer. If they knew who to give credit to, they would have given it to them without hesitation.
Which is why it saddens me how this matter has been escalated in that manner. Over night, TeenStuff has suddenly become a looter, a thief and a rapist of other people's creative work, a fascist establishment that preys on the ideas of others to make money. TeenStuff are not thiefs, they are not scammers, they are not deliberately stealing other people's creative efforts. Whoever helps propagate this horrendous thought has never even picked up an issue of the magazine and read it, and has no idea what the publication is all about. TeenStuff was a place for youth to express their thoughts and show their talents at a time when there were no blogs, no public sharing domains, when the Internet was still rocket science to many. By accusing TeenStuff of plagiarism and theft you are accusing my words, my work, and the words and the work of an entire generation of youth of being plagiarized. You are questioning my honesty, and their honesty, and that is something that I cannot allow.
I am no official representative of the magazine but I can assure you that in the matter of a day or two you will be contacted by a staff representative of the magazine and the matter will be resolved on friendly terms.

I was trying to clear the misunderstanding as of why your e-mail might have not got through yet. Even the biggest corporations in the world take at least one day to respond, and they generally assume that people have got a single grain of patience. And YES, they got 1000s of e-mails per day. They could employ 100s of people to screen through them and people are never going to be satisfied by their response time. Not everyone works there to serve you and serve you alone, they are also serving 1000s of other teens who might as well have problems just like yours or maybe even bigger. If you were so anxious about contacting them you might have as well called or paid them a visit, and their numbers and addresses are listed in the magazine. We are talking about two days: 48 hours! Not two weeks, not two months, just two days!

I am not relieving the magazine from their duties nor am I saying that they did a mistake. All I am saying is that they are not the vicious, cruel sort of establishment you and your fellow bloggers here are describing. I am not defending the magazine's actions: and if you and your friends had been able to communicate the issue in a more respectable, mature way, I'd have stood by your side all the way. What I am against however, is the vicious campaign you and your fellow bloggers have decided to launch against the magazine, because you are under the impression that TeenStuff regularly scams people, steals all its content from honest, hardworking bloggers like you, and that zero creative effort is actually coming from the people who work there. All the conspiracy theory blabber jab that has filled every blog in the last two days is pointless and unjustified. So I am not 'feeding' or 'killing' any monkeys. I never said they didn't make a mistake, I never said they shouldn't apologize or be more careful the next time. All I am saying is that it has been blown way out of proportion.
Now the magazine had been defamed in every Egyptian blog (who I am sure have no idea what they are talking about, apart from the fact that they want to rebel against something), its reputation damaged just because of a simple mistake that could have been resolved on better terms. Now if the magazine does apologize to you and give you your rights, are you going to give them their rights too? If you can sue them for copyright infringement, then be assured that after your friends' unnecessary attacks, they can sue you for defamation too.
Again, I repeat, I was NOT taking sides, I was NOT defending one side's actions. I was trying to clear a misunderstanding (and obviously, I've failed to) and undo some of the damage that has already taken place. I don't think the damage done here could be reversed though, which is why I feel obliged to have my say.

احنا مجلة تين ستاف، و أنا فقط براسلكم من ايميل مجلة كلمتنا حتى تتسنى لي فرصة كتاباته باللغة العربية لتفادي اي سوء تفاهم و لغرض الوضوح التام.
طبعا لقد وصلتنا كل الايميلات المرسلة الخاصة بموضوع الصورة الخاصة بأحمد و المليئة بادعاءات سرقتها و انتهاك حقوقه للملكية الفكرية, و بناء عليه أرجو أن تعتبر أن هذا هو الرد الرسمي للمجلة.
بالطبع انت تعرف أن أي شخص عادي أو جهة رسمية ان يبحث عن الصور على شبكة الانترنت و أن يقوم باستخدامها، مع العلم ان مصادر هذه الصور تختلف من المواقع التي تقوم بشراء الصور من عليها أو المواقع التي على الاقل تقوم بعرض هذه الصور و لكن لا تسمح لك بتحميلها لان حق الملكية الفكرية محفوظ لها كما ان هناك مواقع اخرى تقوم بإباحة استخدام صورها على ان هذه الصور "للمشاركة" على الشبكة. و بالتالي يعتمد تحميل و استخدام أي صور على الشبكة على سياسة الموقع الذي يستضيف هذه الصور. و طبعا انت تعلم أن موقع "فليكر" من المواقع التي نستطيع استخدام الصور الموجودة به و هو الموقع الذي توجد صورتك عليه، و لكن من الواضح أيضا انك لم تقم بقراءة سياسة هذا الموقع و التي تبيح استخدام الصور الموجودة عليه، و دون الخوض في التفاصيل، اليك بعنوان الموقع لتتفقدها بنفسك لانك في حاجة الى ذلك لتعرف انك طالما حملت صورتك على هذا الموقع، فيجب عليك الالتزام بسياسة الموقع و التي تقضي باباحة مشاركة صورتك على الشبكة للعامة، و عنوان الموقع هو:

قدرتنا على تحميل هذه الصورة و التي لم تكن تحمل حتى أسمك عليها تعني أن صورتك لا تملك حق الملكية الفكرية، فيجب عليك تسجيل حق الملكية الفكرية قبل تحميل صورتك على موقع مثل موقع فليكر لمنع الاستخدام العام للصورة، و لكن صورتك لم تكن تحمل حق الملكية الفكرية في المقام الاول.
أما أساس المشكلة بالنسبة لنا تكمن في الادعاءات التي ارسلت لنا:
أولا يا أحمد لقد عملت جاهدة على إيجاد الايميل الخاص بك من المدونة الخاصة بك و هذا يعني انني لم استقبل أي ايميل منك، بل فقط بعض رسائل الايميل من اصدقاءك، و اعتقد انك من المفترض ان تكون على درجة من النضج الكافي لان تتعامل مع مشكلتك معنا بنفسك و ليس عن طريق الرسائل المرسلة لنا عن طريق أصدقاءك، و فوق ذلك انك نشرت في المدونة الخاصة بك انك حاولت الاتصال بنا و نحن لم نرد عليك، على الرغم انه غير صحيح من ناحية و مستحيل من الناحية الاخرى الا نرد على اي ايميل او رسالة نستقبلها لان هذا في صميم عملنا و كل من يكتب في تين ستاف هم شباب متطوعون و يرسلون لنا عن طريق الايميل، لان المجلة بكل بساطة منهم و اليهم. لذا كنت افضل ان يتم التعامل مع موضوع مثل هذا بطريقة متحضرة أكثر من ذلك و التعامل معنا بشكل مباشر، فقد تم ذكر بعض المصطلخات في الرسائل التي أرسلها أصدقاءك لا تليق باي انسان متحضر مثل "إمسك حرامي!!!"" و نشر عبارات من هذا القبيل على المدونة الخاصة بك، بل و الاشارة الى وجود المكتب الرئيسي للمجلة في لندن تلميحا لان تكون المجلة عبارة عن مؤامرة كبيرة و التمسك بنظريات المؤامرة بصفة عامة.
من الواضح ايضا انك لا تعرف أي شيئ عن تين ستاف و لم تقرأها من قبل لان اذا كنت قد قمت بقراءتها ستعرف أن عنوان المجلة هو 22 شارع سوريا بالمهندسين و ان كل كتابها تقريبا من الشباب المصريين و ان العنوان المذكور بلندن ما هو الا اجراء رسمي لجهة اصدرت التصريح نظرا لصعوبة اصداره من مصر منذ 11 عاما، و هو الوقت الذي وجدت في تين ستاف في مصر.
و نحن نعتبر ما حدث و ذكر على المدونة، و الذي لم يبنى على أي وجه حق، هو تشهير بالمجلة و يجب عليك الاعتذار الرسمي فورا على المدونة و ازالة مثل هذه العبارات التي تشهر باسم المجلة في خلال يوم واحد فقط لا غير حتى لا نضطر اتخاذ الاجراءات القانونية و مقاضاتك بتهمة التشهير بالمجلة، و انت تعرف بالطبع أن مباحث الانترنت ستساعدنا في العثور عليك اذا استلزم الامر ذلك.
و في الوقت ذاته نحب ان نقول لك ان باب الصداقة مفتوح بيننا و بينك، و اذا كنت تود المشاركة معنا في مجلتي تين ستاف و كلمتنا بصورك، فنحن سنرحب بذلك جدا حيث ان هذه هي الفكرة الاساسية التي تقوم عليها المجلتين، و هي ان تتم بشكل كامل من الشباب الى الشباب سواء عن طريق كتابة المقالات او اتاحة الفرصة للشباب الفنان مثلك ان ينشروا مواهبهم في المجلة لاتاحة الفرصة للشباب القراء ايضا ان يحتزوا حزوهم.

For those who are under the belief that if this was America or England the culprits would have been arrested within hours, copyright lawsuits are very common in America (and any proper film fan should know they are) and sometimes it takes decades to resolve them, that is if they are resolved in the end.
